Human Resources and Employment Law Issues

Finding and hiring the "best" available talent is an ongoing challenge. Retaining those you hire is yet another challenge. This section provides resources to assist you in these areas.

Pennsylvania is an "employment-at-will" state. This means that anyone may be terminated or may tender a resignation at any time, with or without cause and with or without notice. It is acceptable to terminate for no cause, but it is not acceptable to terminate for an illegal cause. Do you know what they are?

There are many circumstances that may create exceptions to employment-at-will, creating an employment contract of sorts or, at the least, giving the impression of having created a relationship other than one of at-will employment. Do you know where the traps are and how to avoid them?

In addition, are you aware of what statutes, such as the Family and Medical Leave Act or the Americans with Disabilities Act, apply to your firm? Are you confident that your procedures would withstand an audit by the state Department of Labor or Human Resources Commission? When should your firm seek assistance of an employment law attorney? This section helps you begin to address these important employment questions.
