Wonderful discussion. The fact of past litigation with briefs shows
that there was a real issue here.

Just one question: Why did this play out on the RealProperty listserv?

Was it just to wake up those dirt-lawyers with the kind of important,
real-world issues that the death-lawyers address? Take note!

        I had a similar case here in Allegheny County which addressed
this exact
        issue. I am attaching the Argument section of the brief I
filed. After

        filing of this brief, the opposing parties withdrew their
Petition, so I
        am
        assuming that my analysis was correct. In addition, another
party filed
        a
        brief arguing the same points.
